DE LOS DERECHOS Y DEBERES FUNDAMENTALES DO - 10.18002/rjule.v0i8.7085 UR - https://revistas.unileon.es/ojs/index.php/juridica/article/view/7085 SP - 297-315 AB - <p>Las medidas sanitarias impuestas por actos administrativos para hacer frente a la pandemia han suscitado un intenso debate jurídico y político en torno a los requisitos constitucionales y legales para limitar derechos fundamentales (como la libertad personal y de circulación, reunión y manifestación, vida privada y familiar) en favor de la integridad física y salud pública. Más allá del Derecho de excepción, que ampara la restricción y suspensión de derechos fundamentales, el presente estudio se centra en la exigencia de autorización o ratificación contencioso-administrativa de cualesquiera decisiones limitativas en sanidad, según la competencia repartida entre varios órganos jurisdiccionales resultante de la Ley 3/2020, de 18 de septiembre, de medidas procesales y organizativas para hacer frente al COVID-19 en el ámbito de la Administración de Justicia. Intervención judicial que, fuera del amparo del estado de alarma, se ha traducido en autos contradictorios, no tanto a la luz de los requisitos de necesidad y proporcionalidad, y respeto al contenido esencial de los derechos limitados, como en atención a la exigencia de reserva de ley suficiente.</p><p><strong><br /></strong></p><p><strong></strong>The health measures imposed by the administration in the fight against the pandemic have brought about a legal and political debate on the constitutional and legal requirements to limit fundamental rights (such as personal liberty and freedom of movement, assembly and demonstration, private and family life) in favour of public health. Without prejudice to the state of alarm, which protects the restriction of fundamental rights, this study focuses on the requirement for contentious-administrative authorization or ratification of these acts, according to the jurisdiction distributed among various judges and courts resulting from Law 3/2020, of 18th September, on procedural and organizational measures to address the COVID-19 in the area of the administration of justice. Judicial intervention that, outside the protection of the state of alarm, has resulted in conflicting decisions, beyond the constitutional requirements of necessity and proportionality, and respect for the essential content of limited rights, due to the requirement of sufficient legal reserve.</p> ER -
